Privacy Policy
Personal information is information or an opinion about an individual whose identity is known or can be reasonably ascertained from the material.
This Privacy Policy explains how Independent Schools Victoria Limited (ISV) collects and uses the personal information of users of the ISV Procurement Website. This Policy applies to all personal information provided to or collected by ISV. ISV and its commercial website operator comply with the Information Privacy Principles (IPPs), which can be obtained at: https://www.oaic.gov.au/privacy/australian-privacy-principles.
The IPPs govern the way in which ISV collect, use, disclose, store and secure your Personal Information. The IPPs are designed to protect the privacy of individuals by regulating the way personal information is managed. ISV may, from time to time, review and update this policy to take account of new legislation and technology, as well as changes to its operations and practices, and the changing business environment.
By using the isProcurement Website you consent to the collection and use of your information by ISV and by any third party commercial operator ISV may from time to time use to enable ISV to operate the ISV Procurement Website.
Personal Information
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include names, addresses, email addresses, phone numbers. ISV will collect only personal information that is reasonably necessary for, or directly related to ISV’s activities or functions, or to which you have consented.The type of information ISV collects and holds includes: personal information about Member School staff, suppliers and other people who come into contact with ISV.
The isProcurement Website, like most other websites, collects the following personal and non-personal information from users that visit the site:
- A record of your visit,
- Your Internet Protocol address,
- the date and time of the visit to the site,
- Frequency of website visits
- the pages accessed and documents downloaded and uploaded,
- the previous site visited, and
- the type of device, operating system, and browser used.
This information is analysed to determine the website’s usage statistics. No attempt will be made to identify users or their browsing activities, except where, in the unlikely event of an investigation, a law enforcement agency may exercise a warrant to inspect our, or our third party commercial operator’s, records.
Collection of Personal Information
ISV may collect Personal Information about you in the following ways:
- by forms filled out and submitted to ISV by you (including online registration for, or use, our online products and services);
- by emails to us and from us to you;
- when you:
- ask us to contact you;
- create an account with us;
- complete an online survey;
- complete and submit online forms;
- access pages within the ISV Procurement Website;
- in face-to-face meetings and interviews;
- in telephone calls;
- from third party disclosures, including student data from schools and government agencies, or a referral or reference from a school or educational organisation.
Your Obligations when you Provide us with the Personal Information of Others
You must not provide ISV with personal information of any other individual unless you have the express consent of that individual to do so. If you do provide ISV with such information about another individual, before doing so, you:
- must tell that individual that you will be providing their information to ISV and that ISV will handle their information in accordance with this Privacy Policy
- must provide that individual with a copy of (or refer them to) this Privacy Policy;
- undertake that you have that individual’s consent to provide their information to ISV.
Purposes for collection of Personal Information
ISV collect Personal Information for the primary purpose of enabling you to participate in the services available through the South Australian Tenders and Contracts Website, to improve your user experience, for statistical analysis and, if you Opt In to receive marketing material, for the purposes of the Commercial Operator. When ISV collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.
Use of Personal Information by ISV
ISV will only use personal information it collects for the primary purpose of that collection, and for such other secondary purposes that are related to the primary purpose of that collection and are reasonably expected by you or to which you have consented.
ISV Staff Members, Consultants and Contractors
If you are a staff member, consultant or contractor, the primary purpose of collecting your personal information is:
- For statistical and reporting purposes;
- for insurance purposes;
- to provide information to Member Schools;
- to satisfy ISV’s legal requirements; and
- Member School staff and Governors.
If you are a Member School staff member or Governor, ISV’s primary purpose of collecting your personal information is to provide services to Member Schools, including:
- For statistical and reporting purposes;
- the provision of information;
- administration of programs; and
- the promotion of Independent schools to the public.
Use of Personal Information by third party commercial operators
ISV’s third party commercial operators operate the ISV Procurement Website. The commercial operator may use your personal information for the purposes of marketing the services it offers. You may opt in or out of receiving marketing material from the commercial operator at the time you register as a user or at any time later by logging into the isProcurement Website and updating your preferences. You can opt out or unsubscribe at any time by updating your preferences.
Disclosure of Personal Information
ISV may disclose personal information held about you to:
- ISV Member Schools and educational entities;
- government departments and education authorities;
- ISV’s service providers and contractors;
- recipients of ISV publications e.g. newsletters.
ISV will not disclose your personal information to any other third party unless one of the following applies:
- you have consented
- you would reasonably expect, or you have been told, that information of that kind is usually disclosed to that party
- ISV believes, in its absolute discretion, it is in the public interest
- it is required or authorised by law
- it will prevent or lessen a serious and imminent threat to somebody’s life or health.
- In certain circumstances, ISV may share de-personalised aggregated data with third parties to meet its commitments as a service provider to Member Schools and their students. Nothing in this privacy policy prevents ISV from using and disclosing de-personalised aggregated data to others.
Sensitive Information
In referring to ‘sensitive information’, ISV means information relating to a person’s racial or ethnic origins, political opinions, religion, trade union or other professional membership, sexual preferences or criminal record, that is also personal information; and health information about an individual. Sensitive information will be used by ISV, and will be disclosed by ISV, only for the purpose for which it was provided by you or a directly related secondary purpose, unless you provide consent to another secondary use or disclosure, or where the use or disclosure of that sensitive information is allowed by law. ISV will otherwise not use or disclose sensitive information.
Security of Personal Information
There are inherent risks associated with transmission of information via the Internet. ISV takes all reasonable steps to protect the personal information it holds from misuse, loss, interference, unauthorised access, modification or disclosure. However, ISV cannot protect against all potential risks, and you agree that ISV will not be responsible or liable for events arising from unauthorised access of your personal information. Some of the measures ISV implements to protect the integrity of your personal information include:
- locked storage of paper records
- password protected access to all systems and information
- segregated user access to information across all IT systems
- constantly monitored IT systems
- retention of audit records to demonstrate access to systems and information
- full data recovery capability including off site backup
- up-to-date patching of system vulnerabilities as they become known.
- personal information will be retained for only as long as it is needed and it will then be disposed of lawfully and securely.
However, you must also make your own assessment of the potential risks to the security of your information when making a decision as to whether or not you should use the isProcurement Website. ISV and our third party commercial operators will store your Personal Information in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure. When your Personal Information is no longer needed for the purpose for which it was obtained, ISV will take reasonable steps to destroy or permanently de-identify your personal information. However, you should be aware, that as a consequence of obligations which arise out of ISV’s primary purpose to service educational institutions, ISV is in most instances required to retain records including Personal Information collected, for a minimum of 7 years.
Third Party Links and Websites
The ISV Procurement Website contains some links to other websites. When you click on a link to another site, you leave the ISV Procurement Website and are no longer protected by the ISV Procurement Website privacy conditions. ISV is not responsible for the content, terms of use or privacy policy of other websites and makes no warranties as to the completeness, accuracy or currency of information contained on those sites. The links to the other websites do not imply that ISV endorses or supports any of the products or services offered by those third party websites.
Disclosure to third parties overseas
From time to time, for the purpose of carrying out ISV’s functions and activities, ISV may need to disclose personal information to third parties who are located in countries outside of Australia. Countries outside of Australia may have different rules and restrictions, including to lower standards, than the laws applicable in Australia, including the IPPs. Such information will be disclosed to overseas third parties only with your consent and in accordance with this Privacy Policy and with the IPPs.
Maintaining currency of Personal Information
ISV endeavours to ensure that the personal information it holds is accurate, complete and up-to-date. Please let ISV know as soon as possible if there are any changes to your personal information or if you believe the personal information ISV holds about you is not accurate, complete or up-to-date. If you find that the information that ISV have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality tender and procurement sourcing services to you. Otherwise, ISV may from time to time, take reasonable steps to make sure that your personal information is accurate, complete and up-to-date. This may involve ISV contacting you and asking to confirm or update information. To make a request to access your personal information held by ISV or to update your personal information, contact ISV in writing at the address below.
Access to your Personal Information
You have a right to access your personal information held by ISV and to seek corrections to this information, subject to exceptions in the Privacy Act. You may access the Personal Information that ISV hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing at ISV.privacy@is.vic.edu.au. In order to protect your Personal Information we may require identification from you before releasing the requested information.
Complaints
If you wish to make a complaint about a breach of this Privacy Policy or the IPPs, you can contact ISV using the contact details below. You will need to provide ISV with sufficient details regarding your complaint, together with any supporting evidence and information. ISV will refer your complaint to its Privacy Officer who will investigate the issue and determine the steps (if any) that ISV will undertake to resolve your complaint. ISV will contact you if it requires any additional information and will notify you in writing of the outcome of the investigation. If you are not satisfied with our determination, you can contact ISV to discuss your concerns or contact the Australian Privacy Commissioner via www.oaic.gov.au.
